Abstract

This article aimed to comparatively analyze the application of current Mexican legislation in 2024 with the legislation of Germany and Spain regarding the exercise of the right to be forgotten, allowing individuals to delete or de-index inadequate, personal, irrelevant, non-pertinent, or outdated information associated with them. The purpose was to identify best practices, common challenges, and potential areas for improvement in privacy protection and information management. The findings revealed significant differences in approach, scope, and implementation within current Mexican legislation, highlighting that Germany and Spain have established more detailed and clear regulations concerning the application of the right to be forgotten.
