Abstract

The growing recognition of animals as sentient beings has driven significant changes in the legal sphere, particularly with regard to criminal protection against animal abuse. This article analyzes the offense set forth in Article 445 of the Penal Code of the State of Nuevo León to determine whether its legal framework complies with the principles that limit the ius puniendi in a constitutional state governed by the rule of law.
