Contemporary constitutionalism and non-judicial protection of human rights: a critical analysis of the Nuevo León state Human Rights commission and the non-binding nature of its rulings

Abstract

The purpose of this article is to analyze and examine the non-judicial model for the protection of human rights in Mexico, evaluating its effectiveness through two dimensions: a substantive dimension, referring to tangible results in people’s lives, and a practical dimension, understood as actual effectiveness as opposed to mere regulatory existence. The article examines the role of the Autonomous Public Body created for this purpose; however, it criticizes the non-binding nature of its recommendations, as well as the absence of enforcement mechanisms to ensure compliance by the responsible authorities.
