Abstract

This article analyzes the blurring of the limits on constitutional amending power in Mexico, prompted by the tensions arising from the 2024 judicial reform and its effects on constitutional supremacy. Drawing on a comparative theoretical approach, the work engages the contributions of Ferrajoli, Schmitt, Zagrebelsky, Dworkin, and Ackerman, among others, to distinguish between constituent power and constituted power, and to question whether the formal rigidity established in Article 135 of the Constitution is sufficient to contain the amending power.
